Phelps Garage Inc. Retirement Auction Terms & Conditions

TERMS:
Property sells "AS-IS" and "WHERE-IS" without warranties of any kind.  Potential Buyers must perform such independent investigations with respect to the Property as they deem necessary to verify information provided by Auction Company.

WARRANTY :
All information provided by Auction Company is deemed reliable but is not warranted. The information provided by the Auction Company is subject to verification by all parties relying on it.  No liability for its accuracy, error or omission is assumed by the Auction Company.

REGISTRATION:
Bids will be accepted only from registered bidders. You will need a credit card to register online or call for additional options.  The bidding platform may place a $1 temporary charge on your card to ensure it is valid.

ONLINE BIDDING:
This in an online ONLY auction.  Bidding will close in stages at 12 PM (Noon) on Wednesday, March 26, 2025. Lots will close in groups spaced every 2 minutes to allow bidders to keep up with multiple items. There is a soft close meaning if a bid is placed in the last seconds of the auction, the bidding on that item will be extended for 90 seconds until no further bidding occurs.

BUYER'S PREMIUM:
A FIVE PERCENT (5%) Buyer's Premium will be added to the high bid to determine the final sales price. There is an additional 4% fee if paying by credit card.

SALES TAX:
This is a company liquidation. No sales tax will be charged for this auction.

PAYMENT:
NOTE: We do not automatically charge the card used to register.
At the conclusion of the auction, you will receive an invoice to your registered email.
To pay by Credit Card (4% fee), use the payment link in the email prior to pick up.
If paying by Cash or Good Check, you may pay at time of pickup.
Auction company reserves the right to hold items/titles until check or charge clears.
Payment Deadline: Full settlement must not be later than Noon EST on March 29 and prior to item removal.
If payment has not been received by Payment Deadline, your credit card on file will be charged the invoiced amount. If payment does not go through, your account will be in default. If not remedied within one business day, the Auction Company will have the right to immediately resell, store, or discard your item and you will be liable for any associated costs or losses.

APPROVAL:
All items sell at or above the published starting bid.

REMOVAL:
Pickup day is scheduled for:
- Thursday, March 27 from 9am-4pm
- Friday, March 28 from 9am-4pm and
- Saturday, March 29 from 9am-Noon

No items can be removed without a PAID invoice.
All items must be removed by Noon on March 29 unless prior arrangements have been made with the auction company. Any items remaining after this time without Auction Company approval will be considered abandoned and may be resold, returned, or discarded.
Any damage to the real estate by the Purchaser or its agents is the responsibility of the Purchaser.
